♻️ Statement on the EU Winter Package 2025: Plastic waste<\/h3>\n

Moser-Marzi Rechtsanw\u00e4lte has prepared a comprehensive legal opinion on the EU Winter Package of December 23, 2025, for the Austrian Carbon Cycle Circle (\u00d6CC\u00b2) association.<\/p>\n

The European Commission’s pilot initiative provides important impetus for the transition to a functioning circular economy \u2013 but also highlights where legal clarifications and market-stabilizing measures are urgently needed.<\/p>\n

Key points of our analysis:
\n\u2022 Harmonization of end-of-waste criteria as the key to investment security and the functioning of the internal market
\n\u2022 Clear distinction between producer responsibility, testing obligations, and in-house material flows
\n\u2022 Legally secure classification of chemical recycling while maintaining the waste hierarchy
\n\u2022 Critical assessment of the temporary \u201cMade in Europe\u201d credit
\n\u2022 Lack of demand instruments and untested\/uncertified cheap imports of recycled materials as a central systemic deficit of the current approach<\/p>\n

Our conclusion:
\nA functioning circular economy requires not only ambitious targets, but also coherent, proportionate, and market-effective framework conditions that secure European recycling capacities in the long term.<\/p>\n

\nThe new EU Packaging Regulation (PPWR) sets binding rules on recyclability and material use \u2013 starting in August 2026, the implementation of compliance declaration measures will take effect. \nWith the new EU Packaging and Packaging Waste Regulation (PPWR), producers, packers, and companies will face profound changes regarding recyclability and material labeling. The first measures of the new regulation will be implemented as early as August 12, 2026, with the introduction of the mandatory compliance declaration \u2013 a comprehensive self-declaration proving that packaging meets the extensive requirements of the regulation. Binding rules now include minimum recycled content, packaging minimization, as well as requirements for compostability and labeling obligations.<\/p>\n

However, the PPWR not only creates further obligations but also opportunities and potential for sustainable innovations and a future-oriented circular economy. Gain insights into the legal framework, the role of delegated acts, and the planned changes in product design. Special focus will be on plastic-specific regulations.
